1. Our policy

Enzonic LLC ("Enzonic", "we", "us") respects the intellectual property rights of others and expects users of Enzonic Send (the "Service") to do the same. Our Terms of Service and Acceptable Use Policy prohibit uploading or sharing material that infringes anyone's copyright.

We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"), and other applicable laws. We do not pre-screen files, but we act promptly on valid notices.

Because transfers on Enzonic Send expire automatically (within 7 days, plus up to 3 days of extensions), infringing material is often deleted before or soon after a notice arrives. We still process every valid notice and record it for the purposes of our repeat infringer policy.

Our designated agent to receive notifications of claimed infringement is:

Enzonic LLC Attn: DMCA Agent Commonwealth of Kentucky, USA Email: admin@enzonic.com (subject line "DMCA") Online form: https://send.enzonic.com/report

Email or the online form is the fastest way to reach us. Notices sent to other addresses, or about matters other than copyright, may be delayed. For non-copyright abuse, see the Acceptable Use Policy.

3. How to file a takedown notice

Under 17 U.S.C. § 512(c)(3), your notice must be in writing and include all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed. A typed full name is acceptable as an electronic signature.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
  3. Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, with information reasonably sufficient to let us locate it. For Enzonic Send, please provide the full share link (for example, a link beginning with https://send.enzonic.com/) and/or the 6-digit receive code, and the name of the file within the transfer if there are several.
  4. Information reasonably sufficient to contact you, such as your name, postal address, telephone number and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

If your notice does not substantially comply with these requirements, we may not be able to act on it. Where a notice substantially complies with items 2, 3 and 4 but not the others, we will try to contact you to help complete it.

Sample statements

You may use wording like this in your notice:

"I have a good faith belief that use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."

"I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."

4. What happens after we receive a valid notice

When we receive a notice that complies with the DMCA, we will:

  1. remove or disable access to the identified material expeditiously, if it is still available;
  2. notify the uploader, where we have a way to do so (for example, the email address of a signed-in account), and give them a copy of the notice or a summary of it; and
  3. record the notice for the purposes of our repeat infringer policy.

Uploaders who did not sign in may not be contactable because we do not collect contact details for anonymous transfers.

We may share notices, with personal contact details removed or retained as the law allows, with the affected user and with organizations that track takedown requests.

5. How to file a counter-notice

If you believe material you uploaded was removed or disabled because of a mistake or misidentification, you may send a counter-notice to our designated agent at admin@enzonic.com with the subject line "DMCA Counter-Notice".

Under 17 U.S.C. § 512(g)(3), your counter-notice must be in writing and include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (for example, the share link or 6-digit code).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which Enzonic LLC may be found, and that you will accept service of process from the person who provided the original notice or an agent of that person.

What happens next

  • We will send a copy of your counter-notice, including your contact details, to the person who submitted the original notice.
  • If that person does not notify us within 10 business days that they have filed a court action seeking to restrain you from engaging in infringing activity related to the material, we may restore the material or cease disabling access to it no less than 10 and no more than 14 business days after we receive your counter-notice, at our discretion.

Please note: because transfers expire and their files are permanently deleted, material that was removed may have reached its expiry time, or may already have been deleted, before a counter-notice can be processed. In that case it cannot be restored, and you may upload it again in a new transfer if you have the right to do so. A valid counter-notice will still be recorded and taken into account under our repeat infringer policy.

6. Repeat infringer policy

In accordance with 17 U.S.C. § 512(i), we will, in appropriate circumstances, terminate the accounts and block the access of users who are repeat infringers. In deciding, we consider the number of valid notices associated with an account, device or network, whether counter-notices were filed, and other relevant information. Access may also be blocked using the salted hash of the uploader's IP address and other abuse-prevention signals. We may also limit or terminate access for a single instance of infringement where we consider it appropriate.

7. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, by the copyright owner or its licensee, or by us.

Before sending a notice, please consider whether the use may be authorized or may be a fair use. If you are not sure whether material infringes your rights, you may wish to consult a lawyer.

8. Other intellectual property and non-US claims

If your complaint concerns trademarks, or rights under laws other than U.S. copyright law, please email admin@enzonic.com with the subject line "IP Complaint", identify the right and the material concerned (share link or 6-digit code), and explain why you believe it is unlawful. We will review it under our Terms of Service and applicable law.
